Suoja.email Recipient Terms of Use

Welcome to Suoja.email. An existing user of our secure messaging service has sent you a message or a file. This document, the Recipient Terms of Use (“Terms”), is a binding legal contract between you, an individual receiving a communication (“you” or “Recipient”), and Suoja.email Oy (“Suoja.email,” “we,” “us,” or “our”).

These Terms govern your limited access to and use of the Suoja.email secure portal for the purpose of retrieving content.

By clicking the button to authenticate and/or view the message (e.g., “Authenticate & View Message”), you acknowledge that you are the intended recipient of the communication, and you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not proceed.

1. Definitions

  • “Content” means any and all data, text, files, documents, or other information contained within the communication sent to you by a User.

  • “Portal” means the secure web page and related functionality provided by the Service that enables you to authenticate, decrypt, and access the Content.

  • “Service” means the Suoja.email secure messaging platform.

  • “User” means the registered Suoja.email account holder who sent you the Content.

2. Limited License to Use the Portal

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Portal for the sole and exclusive purpose of receiving, viewing, and downloading the Content sent to you by the User. This license does not grant you any right to a Suoja.email account or any other use of the Service.

3. Acceptable Use of the Portal

You agree not to misuse the Portal. This includes, without limitation, any attempt to:

  • (a) Access or attempt to access any Content not explicitly intended for you.

  • (b) Probe, scan, or test the vulnerability of the Portal or any related system.

  • (c) Breach or otherwise circumvent any security or authentication measures.

  • (d) Use any automated system, such as “bots” or “spiders,” to access the Portal in a manner that sends more request messages to our servers than a human can reasonably produce in the same period.

  • (e) Decompile, reverse-engineer, or otherwise attempt to discover the source code of the Portal.

4. Disclaimer of Responsibility for Content

You acknowledge and agree that Suoja.email is a neutral conduit for the transmission of information.

  • (a) We do not create, control, endorse, or take any responsibility for the Content sent to you by the User.

  • (b) The User who sent the Content is solely responsible for its legality, accuracy, and appropriateness.

  • (c) We make no representations or warranties of any kind regarding the Content. Your access to and use of the Content is entirely at your own risk.

5. Disclaimer of Warranties

THE PORTAL AND THE SERVICE ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SUOJA.EMAIL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SUOJA.EMAIL, ITS AFFILIATES, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE PORTAL OR THE CONTENT.

IN NO EVENT SHALL SUOJA.EMAIL’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO YOUR USE OF THE PORTAL EXCEED TEN EUROS (€10.00 EUR).

7. General Provisions

  • Governing Law and Jurisdiction. These Terms shall be governed by and construed in accordance with the laws of Finland. You agree that any legal action arising out of or relating to these Terms shall be brought exclusively in the district court of Satakunta (Satakunnan käräjäoikeus).

  • Entire Agreement. These Terms, along with our Privacy Policy, constitute the entire agreement between you and Suoja.email with respect to your role as a Recipient.
